Operator: Trauma Clinic 2.0 is operated by Essentia Psychological Services Co. (Hong Kong SAR), Business Registration No. 56583587-000-08-19-6 (“Essentia,” “we,” “us,” “our”).
These Terms & Conditions (“Terms”) govern your use of the Trauma Clinic 2.0 directory and website (the “Directory”). By using the Directory, you agree to these Terms and to our Privacy Policy.
1) What We Are (and Are Not)
Directory & resources only. We (Essentia, operating as Trauma Clinic 2.0) provide a human-reviewed directory of independent therapists and trauma-related resources. We may display tiers and/or a suggested care level (e.g., via a quick guide) as educational information only.
Not healthcare, not an emergency service. We do not provide therapy, diagnosis, treatment, crisis support, or clinical supervision. Using the Directory does not create a therapist–client relationship with us.
No matching, bookings, or payments. We do not match you with a therapist, schedule sessions, set fees, process payments, or manage insurance. All contact, decisions, and financial arrangements occur directly between client and therapist.
If you are in crisis, call your local emergency number or crisis line. Do not rely on this site for urgent help.
2) Definitions
Client / Therapy-seeker: an individual browsing or contacting therapists via the Directory.
Therapist / Provider: a mental-health professional who lists a profile in the Directory.
Tiers / Suggested care level: our editorial classification based on information provided by therapists and/or our review of training/experience. It is not a certification or guarantee of outcomes.
Essentia: Essentia Psychological Services Co. (Hong Kong SAR), BR No. 56583587-000-08-19-6, which operates the Directory.
3) Eligibility & Acceptable Use (All Users)
You are 18+ and use the Directory for lawful purposes only.
You will not scrape, copy, or republish content without permission; post harmful/false/defamatory/illegal content; attempt to breach security; or otherwise interfere with the Directory.
We may suspend or remove access for violations of these Terms.
Part A - Client Terms
4) Using the Directory
Information only. Profiles, tiers, and resources are provided to help you make your own choices. They are not medical advice or endorsements.
Do your own diligence. Before engaging a therapist, double verify credentials, licensing/registration, scope of practice, fees, language, cultural fit, and availability. Request informed-consent documents and privacy policies directly from the therapist.
Bookings & payments. You contact and contract directly with the therapist. We are not a party to your agreement and do not handle cancellations, refunds, insurance claims, or complaints about services rendered.
5) No Warranty
We do not warrant the accuracy, completeness, or timeliness of any profile or resource, nor the availability, suitability, safety, or effectiveness of any therapist or service. Outcomes vary and are not guaranteed.
Part B - Therapist Terms
6) Therapist Responsibilities
By listing a profile, you represent and warrant that you will:
Licensure/registration. Hold current, valid credentials and (where applicable) supervision approvals in every jurisdiction where you practise; comply with all local laws and professional codes (including advertising, safeguarding, telehealth, and data protection).
Insurance. Maintain appropriate professional indemnity/malpractice insurance.
Truthful profiles. Provide accurate, up-to-date information (qualifications, training hours, languages, fees, modalities, availability, contact details). Update promptly and remove any inaccurate claims.
Scope & standards. Practise within scope; obtain informed consent; maintain records; manage risk; provide crisis pathways; uphold confidentiality and mandatory reporting duties as applicable.
Payments & contracts. Handle your own bookings, billing, refunds, receipts, and insurance documentation directly with clients.
Client data. Use secure channels and protect personal data in line with applicable law. You are the data controller for your clinical practice.
7) Vetting, Badges & Tiers
We may review public information, training claims, and/or documentation you provide. We may assign or adjust tiers/badges to help users navigate.
These labels are editorial and not equivalent to certification or regulatory approval. We may remove, hide, or edit profiles or badges at our discretion (e.g., incomplete information, complaints, legal risk, or policy concerns).
You agree not to misrepresent our tiers/badges as formal accreditation or imply our supervision of your practice.
8) Listings, Fees & Removal
Directory access for clients is free. Therapist listings may be free or paid (subscription or other model).
We do not guarantee leads, bookings, or income.
We may suspend or remove a listing for breach of these Terms, suspected misconduct, or risk to users. Any refund policies are stated on the purchase page and prevail over this section.
Part C - Content, Privacy & IP
9) User Content & Feedback
If you submit content (e.g., profile data, resources, messages to us), you grant us a non-exclusive, worldwide license to host, display, and use it solely for operating and improving the Directory.
You are responsible for the legality and accuracy of what you submit and for obtaining any permissions required (e.g., images, logos).
10) Privacy (Hong Kong SAR)
Our handling of personal data is described in the Privacy Policy. We aim to handle personal data in accordance with Hong Kong’s Personal Data (Privacy) Ordinance (Cap. 486) where applicable.
Contact between clients and therapists occurs off-Directory; each therapist is responsible for their own privacy, consent, and record-keeping practices.
11) Intellectual Property
The Directory, brand, design, text, graphics, and compilations are owned by Essentia or our licensors and protected by intellectual-property laws. You may not copy or create derivative works without written permission.
Part D - Disclaimers, Liability & Disputes (Hong Kong SAR)
12) Third-Party Links & Resources
We may link to third-party sites (e.g., crisis lines, articles, tools). We’re not responsible for their content, availability, or practices.
13) Disclaimer of Warranties
The Directory is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
14) Limitation of Liability
To the maximum extent permitted by Hong Kong law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, reputation, or goodwill. Our total liability for any claim related to the Directory is limited to the greater of (a) the amount you paid to us in the 12 months before the claim (if any), or (b) [USD 100]. Nothing in these Terms excludes liability that cannot be excluded under Hong Kong law.
15) Indemnification
You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses arising out of your misuse of the Directory or, for therapists, your clinical practice and representations.
16) Changes to the Directory or Terms
We may modify the Directory or these Terms at any time. Material changes will be posted with a new effective date. Your continued use after changes means you accept the updated Terms.
17) Governing Law & Jurisdiction
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of Hong Kong SAR.
Optional: We may agree to mediation/arbitration before litigation.
